I think it likely that the driver didn't actually sue in that case rather it was his insurer. Also, if your dad wouldn't sue in similar circumstances then he would really be doing a disservice to those survivors with the head injuries. Tort law isn't about being noble - it's about trying to make things right the only way we can - with money.
